Monitoring transfer of waste
If you are transporting waste from one country to another, as an exporter or carrier you have to adhere to certain rules. This page briefly indicates which documents need to be present during transport of waste products within, through, to and out of the European Union, and the requirements that the transport of waste products must adhere to. When your paperwork is in order, a possible inspection will go faster.
The Government wants to prevent illegal and environmentally unfriendly processing of waste. That is why Europe has drafted the so-called WSR, the Waste Shipment Regulation 1013/2006.
What needs to be present in the transport of waste products?
Transport of non-hazardous (green list) waste intended for recovery
With the shipment, there must be a completed accompanying document. Officially, this is called 'information accompanying shipments of waste products' but is also called the 'Appendix VII document'. See the accompanying box.
Points of attention for Appendix VII document:
- Make sure that the document completely filled in;
- See if the load corresponds to the description in box 9;
- The document must be signed by the commissioning party of the transport before the transport takes place (box 12);
- The carrier signs the document in box 5 a, b or c prior to his transport;
- Upon receipt, the final recipient of the waste products signs the document in box 13.
Other waste transports
You need a permit for the shipment of:
- hazardous waste products;
- mixtures of waste products;
- non-hazardous waste that will be disposed of;
- waste products that are not listed in the Annexes III or IV of the WSR.
The following documents must be present during transport:
- Copy of Notification Document;
- Copy of written consent and the terms from the relevant authorities;
- Movement document (p. 65 Annex IB, WSR)
The competent authorities of the exporting country and the country of destination must both have given their agreement in writing for the transport.
Points of attention with respect to the notification document:
- See if the load corresponds to the data in box 12;
- Is there written consent from the competent authority? See box 20.
Points of attention with respect to the transport document:
- Does the movement document belong to the notification document? Check the number in box 1;
- Does the sequence number in box 2 fall within the specified number of transports in box 4 of the notification document?
- Fill in box 8 a, b or c;
- Make sure that the notifier has duly completed and signed box 15;
- The establishment where the waste products are disposed of or recovered signs the document in box 17 following the receipt of the waste products.
What do you need for your own records?
Make sure that you have, for your records, a copy of the document signed by the establishment where the waste products are processed, or that it is signed by the following carrier.
VIHB registration
If waste is transported over Dutch territory, then the carrier must have been recognized by the Dutch Government via inclusion on the national list of companies that are allowed to carry, collect, trade or mediate in waste products, the so-called VIHB list of the NIWO Foundation (National and International Road Transport Organization). You should be able to submit this VIHB statement.
Supervisory authorities
The competent authority for the enforcement of the WSR in the Netherlands is the Human Environment and Transport Inspectorate (ILT).
The inspections are carried out in collaboration with:
- Police
- Customs
- Netherlands Food and Consumer Product Safety Authority (NVWA)
- Royal Netherlands Military Constabulary
- Local environmental authorities
